Definitions

Customer:           You and Your

Consumer:          Any person who purchase or acquire goods from us for any purposes which are outside his trade, business or profession.

Goods:                 Any type of hardware or software products sold by us to you including packaging, manuals and any other ancillary accessories or documentation.

Conditions:         Means the terms and conditions of sale set out by this document and any special terms and conditions agreed on sale in writing by good selves.

Customer relations guideline

The purpose of this code is to provide a guide line for a good relation between you and us, and only applies as between you and us if you are or become a consumer. The provisions of the voluntary code may be more or less favourable to customer than the statutory rights. The code is its entire voluntary, and does not affect or reduce any of your statutory rights.  Customers are free to withdraw from the operation of the code at any time and pursue to statutory rights. If in any doubt about statutory rights one may wish to seek for legal assistance or refer to the local consumer affairs department.

 

Purchase of Goods

Today’s market nature in the goods is such that the specifications, versions, description and price of individual goods can change.

We make the utmost effort to ensure that all details, descriptions and prices of any products appearing on the Website are correct at the time input is done into our system. Although we strive to keep the Website as up to date as possible, information including product descriptions and images appearing on this Website at a particular moment may not always reflect the position exactly at the time you place an order. Wherever possible we will accept your order to buy the goods of the specification and description at the price indicated by e-mail / order notification and in which case there will be a concluded the sale.

In the event that it is not possible to accept your order to buy the goods of the specification and description at the price indicated, we shall advise you in writing by e-mail.

Orders are not accepted over the phone, however we may be able to reserve goods for a limited time period. Reservations of goods do not constitute a sale unless accompanied by a non-refundable deposit.

 

Availability of Goods

Products displayed on our website may not be in stock, or defer in colour from the product image, please call us to confirm availability. For online orders availability will be confirmed by a return e-mail from one of our salespersons.

 

Delivery Information

We deliver to Malta in reasonably timely manner and will take place from Monday to Friday between 9:00 and 17:00, unless otherwise agreed.  Unless otherwise stated, the price of the goods does not include delivery, carriage charges and such will be quoted when ordering. Delivery will take place at the delivery address specified by you, must be signed for by an adult capable of receiving goods on your behalf.  Once the goods have been delivered to you (or your representative), you become the owner of those goods and from that point they will be at your risk and responsibility. This means you will be liable for any subsequent damage, loss or destruction. Deliveries do not include installation, Installation services are also provided by us at an extra fee, should this service is required, please request in the ordering stage, and hence will be quoted accordingly.

 

Payment

Payment is to be made in Euro unless otherwise agreed in writing, can be done online or on delivery. We accept cash, or cheques on delivery, and major credit cards are also accepted at our retail outlet.

All goods remain property of Depot230. until paid in full.

 

Right to Withdrawal

You have the right to withdraw from an online sale agreement within 14 days without giving a reason. The withdrawal period will expire 14 days after you receive the purchased product, you must inform us of your decision in writing to withdraw before the withdrawal period expires. We will reimburse you using the same means of payments that you used to pay us, unless otherwise agreed.

The purchased items must be returned to Depot 230 at your cost within 14 days of exercising your right of withdrawal to obtain a refund unless Depot 230 directs you otherwise. Depot 230. may withhold reimbursement until we receive the product. The product must be returned undamaged, in its original packaging with all the original contents, and documentation. If the product or it’s packaging is returned damage, incomplete, or extensive sign or wear, Depot 230 will refuse to accept, or you will be charged for the damages.

Pre-recorded media (including videotapes, DVDs, CDs and other software) must be sealed

 

 

Warranty Terms and Conditions

This warranty does not limit or affect your legal statutory rights.

Depot 230 guarantees that the products sold are free from manufacturing defects, unless stated or agreed on the sale.

Unless stated otherwise on the sales document provided to you on the acquisition of items, the warranty period covers twenty four (24) months from the date of purchase stated on the sales document. The sales document (Invoice/Receipt) should be presented when requiring service under warranty, if in the event you are not able to produce the mentioned documents may delay the servicing process or void the warranty.

Part or Parts replaced by our servicing department carry six (6) months warranty, and in the event of requiring service on the same device / equipment within the servicing warranty period, you need to produce the relevant documentation (Invoice/Receipt/Job sheet).

Batteries by their own or within devices or equipment have twelve (12) months warranty period.

The item must be returned complete including manuals, software and any other items including the original packaging, unless otherwise agreed to Depot230 service centre, at the buyer’s cost. Collection and delivery of faulty items is considered as an extra service not covered by warranty and incur an additional charge.

Products stating warranty period longer than the Depot230 warranty conditions must be dealt directly by the client with the manufacturer.

Manufacturer’s warranty only is limited to hardware failures that become apparent in the product warranty period, Depot230 assumes no responsibility for any subsequent installation of software or transfer of data in the equipment. It is Client responsibility to back up the contents of internal storage on the device before send in for repair or service, as in the course of repair might be needed to clear the entire contents of internal storage. Depot230 will not be responsible for any damage or loss of any software, applications, programs, data or other information stored on any type media storage with in or arising from of the product given for servicing.  Depending on the type of defect and product Depot230 will carry the repair within reasonable time or replace the product, but  cannot be held responsible for losses or damages arising from the product not being available for use before, during or after the period of service provided, or any consequential damage resulting there from. The product may be returned to you configured to its original purchased state.
In the event that the product cannot be repaired and become discontinued, a replacement product may be either new or like new, with same or better specifications provided that its functionality is equal to the original, or client can have the option to go for a depreciated credit note. A full product replacement will only be considered within Depot230 discretion if the product is deemed faulty and returned within one (1) month of purchase with the full original packaging, and documentation.

The warranty will be void if Depot230 or manufacturer’s security seal is found broken or tampered with.

Warranty extension can be purchased on a range of products on or within one (1) month after the sale. However, this does not extend the warranty of power adapters & battery.
Repairs or replacement of the product under the terms of this warranty does not give right to a new starting of the warranty.

 

What warranty does not cover?

Products that turn defective due to fire, overheating, flood, accident, negligence, abuse, misuse, improper handling or operation, natural disaster, improper input voltage, electrical power surge, and liquid spillage.

Products that have apparent damaged due to unprofessional installation, attempted to repair by any party other than at Depot230 service centre, alteration or modification, any third party accessories.

Consumables or parts requiring replacement due to usage, or wear and tear (e.g. ink, toner, imaging unit, optical storage, keyboards, mice, touchpads, batteries, fuses, light bulbs, projector bulbs, body/plastic parts, rubber/seals, glass, brushes/bearings, charging ports, etc….)

Products with serial number or manufacturer label defaced, modified or removed.

Power Adapters or supplies.

Printers which have been used with non-original consumables such as but not limited to ink cartridges, toners, and imaging units during any part of the warranty period.

Software issues, such Operating systems, software updates, software corruption, computer viruses/spyware/malware, games and incorrect firmware upgrades.

 

Charges within the warranty period

Depot230 reserves the right to charge an inspection fee product is found to be working as it should, product is found to be out of warranty, and defect is listed in the exclusions above.

 

Product Returns

Goods are not sold on a trial basis. Depot230 accepts returns only for valid reason of unwanted products within one (1) month but reserves the right to refuse or charge.  A re-stocking fee of 10% of the purchase value applies. Items missing full original packaging or accessories, damaged or non-reseal able are not accepted. Opened consumables such as but not limited to cartridges/toners and also used headphones/earphones cannot be returned.

There’s a 15-day cooling down period for products bought online only and delivered without seeing the product before the sale.

 

Liability Limitations

Depot230 only guarantees the product for its functionality under normal circumstances and use as defined in the manufacturer’s manual, also may be found in the manufacturer’s website.  Depot230 does not guarantee that the Product to fit for any particular purpose. To the extent of local law, in no event shall Depot230 be responsible for impossibility to use the Product, direct, indirect, special, incidental or consequential loss or damage to any person or property. The entire compensation responsibility assumed by the company for the Product shall not exceed the value paid to acquire the Product in terms of each event or related incidents.
